FAIR SOLUTIONS
Some surprising and creative options and resolutions come out of mediation. With clear communication and the mediator’s help with negotiation, unproductive conflict can change from win/lose to win/win. Mediation helps people think outside the box, which can lead to collaborative problem solving. When people are able to work together, they can pool their resources and create plans that will work for everyone.
In mediation, those who are directly involved make the decisions, so they are comfortable with the outcome. Since people make decisions for themselves, they are more likely to follow through with their agreements. Mediators are also trained to help write clear and detailed agreements. Research has shown that compliance with mediated agreements was 90% or greater, and is significantly higher than compliance in court proceedings.
When people use mediation to really talk together–even if they just respectfully agree to disagree–then there are no losers, and they can repair understanding and trust. Mediation can help improve and protect important business or personal relationships, or to end those relationships with dignity and fairness.
